Terms of Service & Privacy Policy

hotelmarketer.ai — a service of Guest & Co B.V., Prinsengracht 759, 1017 JZ Amsterdam, The Netherlands.

For legal clarity the Terms of Service and Privacy Policy are published in English only. Translations are not legally binding; the English version below prevails in case of dispute.

1. The service

hotelmarketer.ai (the "Service") is a monthly subscription that makes hotel data correctly visible to AI search engines (ChatGPT, Gemini, Claude, Perplexity, Grok, Mistral and similar). We implement and maintain a llms.txt file, a one-line AI Connector script, and Schema.org JSON-LD markup for each subscribed hotel. Content is refreshed monthly.

2. Subscription and billing

The Service is billed via Stripe Checkout at €69 per hotel per month (monthly plan), €384 per hotel for 6 months prepaid, or €708 per hotel for 12 months prepaid. Pricing is exclusive of VAT where applicable. Monthly plans can be cancelled at any time from your customer portal; access continues until the end of the current billing period and is not refunded pro rata. Prepaid 6- and 12-month plans are non-refundable but renew automatically and can be cancelled before the next renewal. When a subscription ends — by cancellation or non-renewal — we remove the AI Connector script and your hosted llms.txt: we cannot continue to operate the technical layer outside an active subscription. Resubscribing later is possible at any time; we redeploy everything within 48 hours. Prices are adjusted annually on 1 January in line with the Dutch CBS Consumer Price Index (CPI) and any other applicable cost increases, capped at a maximum of 7%.

3. Your obligations

You confirm that you have the authority to act on behalf of the hotel(s) added to your account. You agree to install the technical components (AI Connector script and /llms.txt redirect) on the hotel website within a reasonable time, and to keep your hotel website's published content accurate.

4. What we do not promise

We do not guarantee specific rankings, visibility or appearances inside any AI assistant. AI assistants make independent decisions about what they show. We do not show live prices or availability inside AI assistants; that requires a separate booking-engine connection that the AI agent must fetch on its own.

5. Data we process

To deliver the Service we process: your account name and email, billing details handled by Stripe, the public content of your hotel website, licensed data from Google Places API and the TripAdvisor Content API, and — where detected — public listings on Booking.com, Expedia and similar online travel agencies. Email delivery is handled by Resend (resend.com). We use Google Analytics and Google Ads to understand site usage; consent is requested through the cookie banner.

6. Sub-processors, sharing and storage

To operate the Service we share strictly the data each sub-processor needs, under a written data-processing agreement (GDPR Article 28). The current sub-processor list is:

  • Stripe (payments & invoicing) — Ireland / United States, EU SCC + Data Privacy Framework.
  • Supabase (Postgres database) — primary region Frankfurt, EU.
  • Netlify (static hosting & serverless functions) — EU/US dual region.
  • Resend (transactional email delivery) — EU/US dual region, SCC.
  • Anthropic (Claude API — property data extraction, content writing) — United States, SCC.
  • OpenAI (ChatGPT API — monthly AI visibility probe) — United States, SCC.
  • Perplexity (Perplexity API — visibility probe + monthly enrichment) — United States, SCC.
  • xAI (Grok API — visibility probe) — United States, SCC.
  • Mistral AI (Mistral Agents API — visibility probe + enrichment) — Paris, France (EU).
  • Google (Places API for property enrichment; Analytics + Ads with consent) — EU/US, Data Privacy Framework.
  • TripAdvisor (Content API — official property data, ratings, reviews) — United States, SCC.
  • Brave Search (search API for cross-checks) — Ireland, EU.
  • Firecrawl (web scraping for hotel page extraction) — United States, SCC.
  • Backblaze B2 (weekly off-site backup) — primary region eu-central-003, EU.

Primary production data is stored within the European Union (Supabase Frankfurt). Some sub-processors are headquartered outside the EU; in those cases data transfers happen under Standard Contractual Clauses (SCC) and, where applicable, the EU-US Data Privacy Framework. Cancelled or deleted accounts move to an internal archive and are permanently deleted after 30 days.

7. Your GDPR rights

You can request access to, correction of, or deletion of your personal data at any time by emailing support@hotelmarketer.ai. We respond within 30 days. You may also lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).

8. Liability

Our total liability to you for any claim arising out of the Service is limited to the fees you paid in the twelve months preceding the claim. We are not liable for indirect, consequential, or incidental damages.

9. Right to refuse or terminate service

hotelmarketer.ai reserves the right, at its sole discretion, to decline a new sign-up or to discontinue an active subscription whenever continuing to operate the Service is not appropriate. Reasons may include — without limitation — misrepresentation, illegal or fraudulent activity, content that conflicts with our editorial standards, or any conduct that materially harms the Service or other customers. When we end an active subscription on these grounds, any prepaid subscription fees covering the period after termination are refunded to the hotel; no further compensation is owed.

10. Governing law

These terms are governed by Dutch law. Disputes are subject to the exclusive jurisdiction of the courts of Amsterdam, The Netherlands.

11. Changes

We may update these terms and our privacy policy from time to time. Material changes are announced through your customer portal at least 14 days before they take effect.
